harry reid has decided not to put it in the gun legislation. dianne feinstein is angry, deeply disappointed, still wants a shot at it. what do you think about the decision by the leadership to not perform a vote on the assault weapon ban? >> i personally have supported a ban on it, i support the second amendment rights, but i think we have to address the issues of weapons of war on our street and do it in a wise way. our majority leader has decided that if he puts that into the base bill going forward, we'll never have a chance to debate the issue that americans want us to talk about -- how do we look at reducing violence on our streets, what are the things we need to do. he wants to bring that bill up, and needs to get 60 votes just to bring it to the floor. we will have an amendment to put the assault weapons ban back in place. we'll see where the votes are, but i think the majority leader is trying to get us to a discussion in the united states senate about this issue that plagues many communities and worrieses every single american sit zen.

luke, you open that segment with a sound bite from senate majority leader democrat harry reid expressing his condolences. but also during that statement, there was an implication there that under sequestration, when budgets are cut, that we may see more of these that it may put the marines and others and soldiers at risk because of the budget cuts. now i can tell you, marine corps officials this afternoon are taking a strong exception to what harry reid implied. saying that this this exercise, for example, was planned well in advance, had nothing to do with the budget cuts. there were no corners cut. and if they couldn't afford to have all the safety precautions into place, they wouldn't do the exercise. and in fact, one marine corps told us just, one marine corps official told us a short time ago, he considers this nothing but pure political posturing on the backs of these dead marines. >> those are some very strong words from the marine corps about senator harry reid, jim miklaszewski thank you soef for being on the program. >>> tonight president obama boards air force one to go to the

>> where things stand is that the majority leader, harry reid, has commendably said we will have a vote, a ban on illegal trafficking and straw purchasing, very significant. a requirement for background checks on all purchases of firearms, including private sales. and a school safety measure. all of them approved by the judiciary committee where i serve and there will be at least two amendments, maybe more, one offered by senator feinstein that will oppose the assault weapon ban and a prohibition on high-capacity magazines, ten bullets or more. >> will those two amendments pass? do they have any chance at passage in your estimation? >> there will be a second amendment that will prohibit high-capacity magazines, separate from the first. in other words splitting out that measure, which i am helping spearhead. now i think there will be significant gun safety legislation. and that the votes are there for some of the elements now and we're working very hard to reach out to some of the swing votes. at this point what's really needed is to mobilize the silent majority. if you look at the polls
